Congress In Constitutional Crisis

June 4, Kathmandu- It is seen that the Nepali Congress will face a constitutional crisis as the scheduled general convention will not be held on time. According to the Congress constitution, the term of office of office bearers and members at all levels of the party is four years. However, in case of emergency, the period can be extended for a maximum of one year.

Congress has used not only the provisions in the constitution but also the provisions in the constitution so far. Accordingly, the tenure of the party's central committee was extended last March using the constitution facility. Article 269, Clause 4 (b) of the constitution states, "If the election of office bearers cannot be held within five years due to special circumstances, there shall be no impediment in the constitution of the political party to hold such election within six months."

Using the same provision of the constitution, Congress had extended the term of the Central Working Committee till next August. Accordingly, it is seen that the legitimacy of Congress may be questioned after August.

The date of the last 14th General Convention scheduled by Congress is August 23 to 26. However, due to the Corona outbreak, the convention is unlikely to take place on that date.

Congress has been working hard for the 14th General Convention. So far, the details of 780,000 active members in the party's central office have been made available online through new distribution and renewal of old ones, according to the party.

About 200,000 members are yet to arrive to reach the target of active members. Congress is yet to see the dispute over the membership. The most controversial issue during the General Convention is the issue of active membership.

Looking at the schedule of the Congress General Convention, it is necessary to start the convention from now on. But, so far from that situation. The only thing left for Congress to do is to issue a formal statement saying that the general convention may not be held on time due to the corona infection. Leaders have already given verbal messages.
