Supreme Court Ruled Authority Does Not Seem Fair!

June 13, Kathmandu-Constitutional Court under the Supreme Court has ruled that the work of the Commission for Investigation of Abuse of Authority is not fair and clean. The bench clarified that the commission is not impartial in the process of appointment of office bearers and staff and the process of their appointment.

The bench noted that the commission has been impartial due to the appointment of a qualified person as the chief commissioner of the commission, allegations of corruption against the officials and staff of the commission, and doubts in the process of appointment of officials and staff in the commission.


The Constitutional Court on Friday questioned the impartiality of the commission while preparing the full text of the final order on the writ petition filed against the arrest of a person working in a public body by paying a bribe. The bench had ordered to issue a writ on the issue on April 21. The Supreme Court had ordered the resignation of former Chief Commissioner Lokman Singh Karki in 2016 A.D.,  stating that he was appointed to the post without the required qualifications.

Similarly, former Chief Commissioner Deep Basnyat and Commissioner Rajnarayan Pathak have been charged with corruption by the authorities. Some employees are also involved in bribery scandals. There have been allegations of money laundering and selection of relatives even when the chief commissioner and the commissioner were appointed in the commission. The order of the Constitutional Court states, "In this case, the assumption of impartiality is guaranteed on the basis of the Commission's constitutional status, which does not constitute an objective view." Impartiality and cleanliness must be established by action. '
