Cause order issued for the appointment of officials on constitutional bodies

The Supreme Court has issued an order in the name of the government to submit reasons for the appointment to the constitutional body. A single bench of Justice Kumar Regmi on Friday issued an order in the name of the government to submit reasons for the recent appointment of officials in the constitutional commissions.

Hearing the petition of senior advocate Dinesh Tripathi, the apex court has demanded a written reply from the opposition. Tripathi had filed a petition against the swearing in of 34 office bearers in the constitutional commissions contrary to the provision of the constitution to be heard in the House of Representatives.

Before the dissolution of the House of Representatives, the government had amended the Constitutional Council Act through an ordinance and recommended officials to the Commission for Investigation of Abuse of Authority, Human Rights Commission and other constitutional bodies. The recommendation of the Constitutional Council meeting held on December 16 was made public only after the dissolution of the House of Representatives on December 19.

After the dissolution of the House of Representatives, the Parliamentary Hearing Committee could not sit and the government had registered the names of those recommended in the Secretariat of the House of Representatives.

He was administered the oath of office by Chief Justice Cholendra Shamsher Rana at the President's Office on Wednesday, 45 days after the notice was registered. Senior Advocate Tripathi had filed a writ petition in the Supreme Court even before Chief Justice Rana took oath.

He had filed a writ petition with a petition to stop the proceedings even after taking oath. The writ petition claims that the appointments made unconstitutional in the case where the constitution has made the hearing of the House of Representatives mandatory.
