Durga Prasai Files Writ Of Habeas Corpus In Supreme Court

Nov 22, Kathmandu- Medical practitioner Durga Prasai, who is in police custody, has filed a writ of habeas corpus in the Supreme Court. He filed the writ in the Supreme Court today through his legal practitioner, alleging that he has been illegally detained.

Court spokesperson Achyut Kuinkel informed Annapurna that the writ filed by Prasai has been registered. He said that the hearing of the writ has been scheduled for Sunday.

The Central Bureau of Investigation arrested him on Mangsir 4 on charges of spreading false propaganda and rumors against Prime Minister KP Sharma Oli using 'fake documents'.

Police have said that action will be taken against him under the Electronic Transactions Act.

The document that Oli made public on social media, claiming that he had invested in Cambodia, contained Prime Minister Oli's name and a fake signature. Police have also increased surveillance on those who are spreading the 'fake document'.

Earlier, the Kathmandu District Court had granted Prasai an arrest warrant for an investigation into an offense under the Electronic Transactions Act. The police took control of Prasai immediately after his arrest.

On Ashwin 15, the Kathmandu District Court ordered Prasai to be released on bail for cyber-related offenses. He was released after posting a bail of one hundred thousand rupees. The police have taken him back into custody for allegedly spreading misinformation against Prime Minister Oli using a 'fake document'.

A case has been filed against him earlier, demanding a five-year prison sentence for committing an offense under Section 47 of the Electronic Transactions Act. The verdict in the case is yet to be announced.
