Jan 27, Kathmandu- Rashtriya Swatantra Party (RSP) Chairman Rabi Lamichhane has been presented in the High Court against the District Court's order to release him on bail of Rs 6.5 million in the Surya Darshan Cooperative fraud case in Pokhara.
Lamichhane has registered a petition at the Pokhara High Court on Monday to have the case heard on a regular date.
Kaski District Court Judge Nitij Rai had ordered Lamichhane to be released on bail of Rs 6.5 million on Paush 25. The order to release him on bail was welcomed by the RSP workers. Lamichhane himself had thanked the court for not denying justice. The order states that the bail was sought because there was no evidence that Lamichhane was not involved in government fraud.
However, the government prosecutor has already appealed to the higher court, saying that Lamichhane, who is due to appear in court, has been released on bail. The higher court has already sought the district court's order.
"Unsatisfied with the Kaski District Court's order to demand bail under Section 68 of the Criminal Procedure Code in its hearing on the detention on Paush 25, RSP Chairman Rabi Lamichhane has filed a petition under Section 73 in the Pokhara High Court, seeking to have the case tried on a regular date as per Section 69," said Lamichhane's legal practitioner Dr. Narayan Dutta Kandel.
