Mar 07, Kathmandu- South Korean court on Friday overturned the arrest of impeached President Yoon Suk-yeol and allowed him to be released. Lawyers for the ousted president filed a request to quash his arrest last month, arguing that his detention was unlawful. Prosecutors have waited too long to indict him.
“It is reasonable to conclude that the defendant was charged after the period of detention has expired. It is considered appropriate to issue a decision to cancel the detention in order to ensure procedural clarity and remove any doubts about the validity of the investigation process,” a document from the Seoul Central District Court said.
Former prosecutor Yoon has been in turmoil in South Korea since he briefly suspended civilian rule and sent the military into parliament in December. A few hours before the impeachment, the parliamentarians voted against him and filed a motion to charge him with 'coup d'état' for declaring military rule.
Yun, 64, had resisted arrest for two weeks after tense clashes between security forces and investigators at his Seoul government residence. He was finally taken into custody on January 15.
He is also facing an impeachment trial in the Constitutional Court, which will decide whether he can be removed from office.
