Apr 21, Kathmandu- The Supreme Court is continuing its hearing on the writ petitions filed against 52 officials appointed fraudulently in constitutional bodies today as well.
Earlier, the hearing was held yesterday, Sunday. The hearing has continued today as well.
In 2077 Mangsir and 2078 Jestha, the then Prime Minister KP Oli had amended the Constitutional Council Act twice through ordinances and appointed officials without parliamentary hearings. The writ petitions filed against that are being heard on Wednesday.
The writ petition is being heard by a five-judge constitutional bench comprising Chief Justice Prakash Man Singh Raut and Justices Sapna Pradhan Malla, Manoj Kumar Sharma, Kumar Chudal and Nahakul Subedi.
The final hearing of the writ petition against the appointment, which was stalled without hearing for four years, began on Magh 30.
After the hearing was affected for four years, the bench itself had ordered the hearing to be held on July 11 without moving the hearing and without adjourning the case. But even after that order, the trend of delaying the hearing has not stopped. The same writ is being heard in the Constitutional Bench on Monday as well.
The Constitutional Bench formed to hear the writs includes Chief Justice Prakash Man Singh Raut, senior-most justice Sapana Pradhan Malla, Manoj Kumar Sharma, Kumar Chudal and Nahakul Subedi.
Only Chief Justice Cholendra Shumsher Jabra and National Assembly Speaker Ganesh Prasad Timilsina were present in the then Constitutional Council led by Oli.
Although Speaker Agni Prasad Sapkota and opposition leader Sher Bahadur Deuba did not attend the meeting, Oli had given positions to his close associates, contrary to constitutional and democratic values.
Oli has been accused of abusing the constitutional body through the officials appointed by Oli in a fraudulent manner.
