May 15, Kathmandu- The Biratnagar High Court has ordered the production of the original file of the savings embezzlement case of the Umagori Agricultural Cooperative Society.
The bench of Acting Chief Justice Dhruvraj Nanda on Thursday ordered the production of the original file to hear the petition filed against the district court's order.
Anjala Koirala, wife of Hrishikesh Pokharel, chairman of the Public Accounts Committee of the Federal Parliament, is also a defendant in the savings embezzlement case of this cooperative. The District Court, Morang, had ordered the release of the accused on a bail of Rs 1 million for trial. The government attorney had approached the High Court against the district court's order. After a difference of opinion between two judges in the High Court, another bench was appointed.
The District Court, Morang, had released Koirala and six others on bail pending trial in the savings embezzlement case of the Umagori Cooperative Society located in Dhanpalathan-4, Morang. Two directors, including the chairman, Sambhu Prasad Rauniyar, were sent to detention. On Baisakh 11, while hearing the writ petition filed against the district court order, the opinions of Biratnagar High Court Judges Shreedhara Kumari Pudasaini and Keshav Prasad Bastola differed.
Judge Sridhara Kumari Pudasaini had given the opinion to uphold the district court's order. However, Judge Keshav Prasad Bastola disagreed with Pudasaini's opinion and gave the opinion that the bail should be increased to 10 million rupees. After that, another bench has been appointed for the remand order. The next hearing of this case will be on Thursday.
