May 30, Kathmandu- A complaint has been filed with the Judicial Council against two judges of the Birgunj bench of the Janakpur High Court, who acquitted Nepali Congress leader Mohammad Aftab Alam, who was found guilty of burning a man alive in a brick kiln.
A complaint has been filed with the Judicial Council, demanding action against the judges of the Birgunj bench of the Janakpur High Court, Khushi Prasad Tharu and Arjun Maharjan, who acquitted Alam after the Rautahat District Court had already found him guilty.
Yubaraj Safal filed a complaint against both these judges on Friday. The complainant has demanded a judicial review by immediately suspending the judges and acquitting Alam.
"I have submitted this complaint demanding an examination of the justice delivery work done by the said judges Tharu and Maharjan while they were in the district court or high court and the orders they made, and to immediately suspend the said judges and take other departmental action as per the Judicial Council Secretariat Act," he said in the complaint.
Alam was accused of burning 23 people alive in a brick kiln during the 2006 Constituent Assembly elections.
On Kartik 29, 2076, the Rautahat District Court ordered Alam to be sent to prison for trial. A single bench of Judge Matrika Prasad Acharya sentenced defendant Alam and others to life imprisonment.
After the High Court overturned the District Court's order, there has been much criticism and opposition across the country regarding the role of the judiciary.
